Terms of Service
and Acceptable Use Policy
Deadserious.net Web Hosting has
developed this terms of service and
acceptable use policy to better serve
our customers and offer the most
reliable and best possible
environment.
Content All services provided
by Deadserious.net Web Hosting may be
used for lawful purposes only.
Transmission, storage, or presentation
of any information, data or material in
violation of any United States Federal,
State or City law is prohibited. this
includes, but is not limited to:
copyrighted material, material we judge
to be threatening or obscene, or
material protected by trade secret and
other statute. You agree to hold
harmless Deadserious.net Web Hosting
from any claims resulting from the use
of the service which damages you, your
company/orginazation or any other
party. Pornography and sex related
merchandising are prohibited on any
Deadserious.net Web Hosting server.
This is also true for sites that
promote any illegal activity or content
that may be damaging to Deadserious.net
Web servers or any other server on the
internet.
Examples of non acceptable content or
links are, but not limited to:
Pirated software
Hackers programs or archives
Warez Sites
Adult Sites
Game Servers
Unauthorized use of MP3's
Chat Rooms We currently do not
allow clients to install their own chat
rooms. Most chat rooms tend to be large
system hogs and we cannot allow that.
Note: phpMyChat and chat rooms that run
on other servers that you simply embed
or link to within your site are
perfectly fine to install.
IRC We currently do not allow
IRC, egg drops, or IRC bots to be
operated on our servers.
Background running programs We
may allow programs to run continually
in the background, these are considered
on a case by case basis and an extra
charge may be incured based on system
resources used and operational
maintenance needed.
Violation Violations of system
or network security are prohibited, and
may result in criminal and civil
liability. Deadserious.net Web Hosting
will investigate incidents involving
such violations and may involve and
will cooperate with law enforcement if
a criminal violation is suspected.
Examples of system or network security
violations include, without limitation,
the following:
1. Unauthorized access to or
use of data, systems or networks,
including any attempt to probe, scan or
test the vulnerability of a system or
network or to breach security or
authentication measures without express
authorization of the owner of the
system or network.
2. Unauthorized monitoring of
data or traffic on any network or
system without express authorization of
the owner of the system or
network.
3. Interference with service to
any user, host or network including,
without limitation, mail bombing,
flooding, deliberate attempts to
overload a system and broadcast
attacks.
4. Forging of any TCP-IP packet
header or any part of the header
information in an email or a newsgroup
posting.
5. Use of Deadserious.net Web
Hosting service to transmit any
material (by e-mail, uploading, posting
or otherwise) that threatens or
encourages bodily harm or destruction
of property.
6. Unsolicited commercial
e-mail / Unsolicited bulk e-mail (SPAM)
Use of Deadserious.net Web Hosting
service to transmit any unsolicited
commercial or unsolicited bulk e-mail
is expressly prohibited. Sending a
message, especially an advertisement,
to more than five or six recipients, is
by itself spamming unless the
individuals have specifically requested
to be added to a mailing list on that
topic. E-mail is a person-to-person
medium, not a broadcast medium.
Violations of this type will result in
the immediate termination of your
account.
Data Integrity
A backup of all Web site, email, and database data is made once daily. Although every conceivable effort is taken to ensure the integrity of the hosted data, DeadSerious cannot be held
responsible for the loss of data from any Web site, email, or database. All clients are reminded to maintain a current copy of their
Web site, emails, and databases on their local systems.
Payment Policies All payments
are in U.S. currency. Deadserious.net
Web Hosting currently accepts Visa,
MasterCard, American Express,
Discover/Novus, Diners Club and JCB and
derivatives of those brands. We also
accept checks, money orders, cashiers
checks and paypal. All payments made by
credit card are set up on auto billing
unless prior arrangements have been
made. It is your responsibility to have
sufficient funds to cover the
transaction on your corresponding
billing date. Payments are due on your
corresponding billing date. Your
billing date is the day the order was
placed and processed. With the
exception of plans including 30 day
money back guarantee, annual payments,
and our 99% uptime guarantee no refunds
will be given on any services.
All invoices posted to your account will be due and payable Net 30. Accounts with an overdue balance may be subject to a $10.00 per month fee or a 2% per month charge on the Total Amount of the overdue invoice (whichever is greater). Delinquent accounts will be suspended after 60 days non-payment, with service to be reinstated after payment in full is received. Delinquent accounts' settings and data will be permanently deleted from the server(s) after 90 days non-payment.
All charges will be considered valid unless otherwise disputed in writing within 10 days from invoice submittal. After this time, DeadSerious.net will consider your bill to be correct. If the account becomes delinquent, and it becomes necessary to forward this account to an attorney or collection agency for collection, the Customer agrees to pay any reasonable attorney or collection agency fees, plus all other reasonable costs for collection, including court costs. There will be a
$10.00 Fee for checks returned to us
due to insufficient funds or any othe
reason. You are responsible for all
money owed on your account from the
time it was established to the time
that you notify Deadserious.net Web
Hosting a request for termination of
services.
Cancellation Deadserious.net
Web Hosting reserves the right to
cancel service at any time.
Deadserious.net Web Hosting provides
three easy methods of cancellation.
Cancellations can be made either
through the helpdesk, email, or in
writing to Deadserious.net Web Hosting.
The follwing information must be
included in all cancellation
requests:
Your full name:
Your primary domain name:
Your user name, and password:
To cancel via email:
Send email to billing@Deadserious.net
with cancellation as the subject and
include all the required information as
stated above.
Refunds All of
Deadserious.net's shared Web Hosting
plans are backed by a 30 day money back
guarantee. If you are not completely
satisfied with our services or support
within the first 30 days of your
service, you will be given a full
refund. This does not include extra
services such as storage, bandwidth, ip
addresses etc. Cancellation requests on
the 30th day will not receive the
option of a refund. With the exception
of plans including 30 days money back
refunds will be posted for full months
only. Notice of cancellation must be
given before the month in question
begins. For web hosting accounts that
are paid annually, Deadserious.net Web
Hosting will refund all unused months
if a proper cancellation is submitted.
Refund payments will be made within 30
days from cancellation by company check
or by issuing credits to your credit
card. If you violate this terms of
service agreement, you will not be
provided the option of a refund.
By opening an account the
individual(s) responsible for the
account agree to all of the Terms and
Conditions without question. Anything
not listed in the Terms of Service is
open to interpretation and change by
Deadserious.net administrators without
prior notification.
